What you will do

As the Sr. Counsel DACH you will report directly to the Legal Director, Continental Europe, with a dotted line to the General Managers Germany, Austria and Switzerland. As the Sr. Counsel you will manage a team of two other legal & contract counsels (located in Germany). You will pro-actively drive service and operational excellence across the Company’s Central European businesses in fields such as security and fire safety, HVAC, air systems, building management systems, and related services and products, mainly for commercial and industrial clients.  You will serve as a key member to the regions’ Senior Leadership Teams, as a strong and trusted business partner to its clients, and as an active member and collaborator within the greater Continental European Legal team, and more broadly within the EMEA-wide Legal Department.  Furthermore, you will also work collaboratively with Legal Directors for Litigation EMEALA, Labor & Employment EMEA, and Regional Compliance EMEA, respectively. 

How you will do it

  • Regular functional reporting to the Legal Director, Continental Europe and active participation and engagement in the Continental Europe legal leadership team effectively supporting transformation and enhancement efforts of the Legal function in JCI; support the Legal Director Continental Europe on key strategic matters and initiatives
  • Lead, supervise, manage and develop the DACH Legal Team and drive engagement, continuous improvement of effectiveness and efficiency of the team
  • Effectively influencing and leading cross-functional resources to identify risks, create action plans to mitigate risks, and assure continuous monitoring and improvement throughout the areas of responsibility. Effectively garner support for same from global, regional and local stakeholders
  • Regular and proactive business-line reporting to the General Managers and Finance Directors for Germany, Austria and Switzerland and functional leadership as a trusted and recognized legal business partner with a strong entrepreneurial acumen and business mindset on legal matters affecting their businesses
  • Proactive collaboration with the Director, Regional Compliance EMEA to drive “tone at the top” and a “speak up culture” to sustain a robust environment of integrity, including support of investigations and remediation in compliance matters
  • As an individual contributor, driving proactive solution-focused practical legal guidance on commercial transactions, installation and other projects, claim and risk management for the businesses
  • Driving continuous improvement and high levels of performance against key performance indicators of service, contract and installation excellence (e.g., cost, claim, change order management, client engagement and training, improving AR collections and reducing liabilities, as well as other drivers of performance excellence)
  • Proactive collaboration with Legal Director, Litigation EMEALA to reduce the overall-cost of disputes and litigation and to ensure effective management of litigation and arbitration proceedings
  • Proactive, transparent, effective and efficient collaboration and interaction with other peers in the EMEA region and broader global legal and installation excellence team members to effectively promote sharing of best practices, stream-lining of processes for efficiency and effectiveness, and strengthening communication and interaction
  • Effectively influencing and leading cross-functional resources to identify risks, create action plans to mitigate risks, and assure continuous monitoring and improvement throughout the areas of responsibility.  Effectively garner support for same from global, regional and local stakeholders
  • Proactively working to optimize outside counsel service quality and cost controls

What we look for

  • Admitted to practice law in Germany with a minimum of 8 years international practice experience (including experience in an international law firm and +5 years senior in-house experience within an international corporation), preferred candidates will also have some common law experience and training
  • Prior leadership experience within a German in-house legal team
  • Experience and background in managing German labor & employment matters, including dealing with Works Councils
  • Background and experience with solving legal and regulatory issues in Germany and greater Central Europe of relevance to the buildings and facilities equipment and services businesses, construction, etc.. Solid understanding of the German, Austrian and Swiss construction industry and its legal environment
  • Strong commercial background and contract & claims management skills and experience in dealing with customer claims, change orders etc.
  • Strong team-player with the ability to work – as a loyal member of the Continental Europe Legal Team – within a transparent team framework, a matrixed organization, and across multiple cultures
  • Native German fluency and near-native business English fluency (preferred candidates will also have additional European language fluency)
  • Proficient in use of word processing and other data processing programs, especially Word, Power Point and Excel
  • Proficient in project management skills and tool sets
  • The ability to lead, inspire and manage effectively with unquestioned integrity
  • Self-motivation with ability to manage and regularly prioritize a very heavy workload under time and cost pressure
  • Excellent analytical and communication abilities
  • Understanding commercial objectives and realities, and the ability and desire to solve complex problems practically whilst maintaining the highest quality of legal practice and advice for the business to protect the company  
  • Strategic, collaborative thinking around program and process enhancement
  • Excellent interpersonal skills with the ability to relate comfortably and transparently at all levels within an organization, and with culturally-diverse, international personnel in a smooth and efficient fashion
  • Exceptional presentation, professionalism, and advocacy skills with the ability to promote and defend the interests of the business with regulators.
  • The ability to meet challenges confidently, and react ethically, quickly, and helpfully in a fast-paced environment
